Article 1 – Definitions
In these terms and conditions, the following definitions apply:
- Right of Withdrawal: The right of the consumer to cancel the agreement within the cooling-off period without giving any reason.
- Consumer: The natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the entrepreneur.
- Entrepreneur: The natural or legal person offering products and/or services to consumers at a distance.
- Cooling-off period: The period during which the consumer has the possibility to cancel the agreement without providing reasons.
- Model Form: The model form for withdrawal, which the entrepreneur makes available to the consumer.
Article 2 – Identity of the Entrepreneur

Article 3 – Applicability
These general terms and conditions apply to every offer made by the entrepreneur and every distance contract and order concluded between the entrepreneur and the consumer. Before the remote agreement is concluded, the text of these general conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated that the general conditions are available for perusal at the entrepreneur’s premises and that they will be sent to the consumer free of charge upon request.
If the distance contract is concluded electronically, the text of these general terms and conditions will be made available to the consumer in electronic form in such a way that the consumer can easily store them on a durable data carrier. If this is not reasonably possible, it will be indicated where the general terms and conditions can be viewed electronically, and they will be sent to the consumer free of charge, either electronically or in some other way.
In case specific product- or service conditions apply in addition to these general conditions, the second and third paragraphs apply accordingly, and the consumer can always rely on the most favorable provision in case of conflicting general conditions.
Article 4 – The Offer
If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer. The offer is without obligation, and the entrepreneur is entitled to change or adapt the offer at any time. The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow the consumer to properly assess the offer. If the entrepreneur uses images, these are a true reflection of the products and/or services offered. However, the entrepreneur cannot guarantee that the colors of the products shown will exactly match the actual colors due to differences in screen displays.
The entrepreneur is not liable for any mistakes or errors in the product descriptions, such as ingredients, weight, or other details. The consumer is advised to consult the product packaging for the most accurate and up-to-date information regarding product content, ingredients, and weight specifications. All images, specifications, and data in the offer are indicative and cannot lead to compensation or dissolution of the agreement due to errors.
Article 5 – The Agreement
The contract is concluded when the consumer accepts the offer and the conditions thereby stipulated are fulfilled. If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of the electronic acceptance. Until the acceptance is confirmed by the entrepreneur, the consumer may dissolve the agreement.
If the agreement is created electronically, the entrepreneur will take appropriate technical and organizational measures to protect the electronic transfer of data and ensure a secure web environment. If the consumer is able to pay electronically, the entrepreneur will take appropriate safety measures. The entrepreneur can, within legal frameworks, assess the consumer’s ability to meet their payment obligations and determine whether the agreement can be concluded. The entrepreneur is entitled to refuse an order or application or attach special conditions to the implementation.
Each agreement is entered into under the condition that the products concerned are sufficiently available.
Article 6 – Right of Withdrawal
The consumer has the right to withdraw from the agreement within 14 days without providing a reason. The cooling-off period starts the day after the consumer receives the product or the product is delivered to a designated representative. During this cooling-off period, the consumer must handle the product and packaging with care. The consumer may only unpack or use the product to the extent necessary to judge whether they wish to keep it.
If the consumer wishes to exercise their right of withdrawal, they must notify the entrepreneur within 14 days of receiving the product. The consumer must return the product within 14 days. The consumer should retain proof of posting to demonstrate the timely return of the product.
Products that cannot be returned include custom-made items, hygienic products, products with a broken seal, and products with a limited shelf life.
Article 7 – Costs in Case of Withdrawal
If the consumer exercises their right of withdrawal, the maximum amount they can be charged is the cost of returning the product. If the consumer has paid an amount, the entrepreneur will refund this amount as soon as possible, but no later than 14 days after withdrawal, provided that the product has been received by the entrepreneur or sufficient proof of return is provided.
The consumer is liable for any reduction in value of the product due to careless handling.
Article 8 – Exclusion of Right of Withdrawal
The entrepreneur may exclude the consumer from the right of withdrawal for products that were created by the entrepreneur according to the consumer’s specifications, products that cannot be returned due to their nature, products with limited shelf life, single newspapers and magazines, audio or video recordings, computer software (if the seal is broken), hygienic products, or products with health risks if the consumer has broken the seal.
Article 9 – The Price
Prices can be increased at the discretion of the entrepreneur. The prices mentioned in the offer for products or services include VAT. However, all prices are subject to typographical errors and mistakes. The entrepreneur is not liable for any consequences of errors, including incorrect pricing. If a price error occurs, the entrepreneur is not obliged to deliver the product at the incorrect price.
Article 10 – Compliance and Warranty
The entrepreneur guarantees that the products and/or services fulfill the contract, specifications in the offer, and reasonable requirements for reliability and serviceability. If agreed upon, the entrepreneur also guarantees that the product is suitable for use beyond normal expectations. Defects or wrongly delivered products must be reported to the entrepreneur in writing within 2 months after delivery.
The warranty period is in accordance with the manufacturer’s warranty period. The entrepreneur is not responsible for the product’s suitability for a particular purpose unless otherwise agreed.
The warranty does not apply if the consumer has repaired or altered the product themselves, or if the product has been exposed to abnormal conditions or handled carelessly.
Article 11 – Delivery and Execution
The entrepreneur will take the greatest possible care in processing orders and delivering products. The place of delivery is the address provided by the consumer. Orders will be delivered within 30 days unless the consumer has agreed to a longer period. If delivery is delayed or the order cannot be filled, the consumer will be informed within 30 days, and they have the right to cancel the agreement.
If delivery is not possible, the entrepreneur will attempt to provide a replacement product. The consumer will be informed about this at the time of delivery.
The risk of damage or loss of products rests with the entrepreneur until the moment of delivery.
Article 12 – Payment
Unless otherwise agreed, the consumer must pay the amounts owed within 7 working days after the cooling-off period starts. If payment is not made within this period, the entrepreneur is entitled to charge reasonable collection costs.
Article 13 – Complaints Procedure
The entrepreneur has a well-publicized complaints procedure. Complaints about the implementation of the agreement should be submitted to the entrepreneur within 2 months of discovery. The entrepreneur will respond within 14 days, and if the complaint is justified, the entrepreneur will replace or repair the product.
Article 14 – Disputes
On agreements between the entrepreneur and the consumer to which these terms and conditions relate, only Dutch law applies. The Vienna Sales Convention does not apply.
